2. Definitions

- “Inspection Services”: Refers to the visual inspection of high-pressure cylinders (e.g., scuba cylinders) and related services such as oxygen cleaning and eddy current testing, performed in accordance with industry standards (e.g., PSI/PCI, OSHA, CGA, UN ISO).
- “Training Services”: Refers to the provision of scuba diving instruction and certification courses, including SDI and PADI programs.
- “Inspection Record”: Digital record of a completed cylinder inspection, accessible via the Website using a unique identifier (e.g., QR code, serial number).
- “Materials”: All content, information, data, text, graphics, designs, logos, trademarks, images, sounds, video, and other intellectual property displayed on or available through the Website.
3. Services Offered
3.1. Inspection Services: We provide professional visual inspections of high-pressure cylinders and related services. All inspections are conducted by certified personnel in accordance with current industry standards and best practices.
Accuracy of Inspection Information: While we strive for accuracy, inspection results reflect the cylinder’s condition at the time of inspection. We are not responsible for subsequent damage, changes to the cylinder’s condition, or improper use of the cylinder after inspection. Inspection Records: Inspection records are provided for informational purposes only to the owner/designated party of the cylinder. Access is typically via a unique identifier. We reserve the right to determine how long records are stored and any limitations on their use or sharing.
3.2. Training Services: We offer SDI and PADI scuba certification courses.
Enrollment: Enrollment in courses is subject to availability, prerequisite fulfillment, and completion of all required forms and payments. Medical Requirements: Participants must meet specific medical requirements as stipulated by SDI, PADI, and/or Skelly Scuba, LLC. This typically involves completing a medical questionnaire and potentially obtaining a physician’s clearance. Refunds/Cancellations: Specific refund and cancellation policies for courses are detailed in Section 5.3 (Refunds) and will be provided in your individual course enrollment agreement. Certification: Certification is awarded upon successful completion of all course requirements, including academic, confined water, and open water components, as per SDI/PADI standards.
4. User Obligations and Acceptable Use
4.1. Accuracy of Information: You agree to provide accurate, current, and complete information when requesting Services or registering for courses.
4.2. Responsible Use: You agree to use the Website and Services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Website.
4.3. Prohibited Activities: You agree not to:
- Misrepresent your identity or affiliations.
- Attempt to gain unauthorized access to any part of the Website or its systems.

4.5. Minimum Age: You must be at least 18 years old to directly contract for our Services. Participants in scuba training courses under 18 years old must have verifiable parental/guardian consent and meet all dive agency minimum age requirements for specific courses.
5. Payment and Refund Policy
5.1. Pricing: All prices for Services are listed on the Website or provided via quote and are subject to change without prior notice.
5.2. Payment: Payment for Services is due upon booking for courses or upon completion of inspection services, unless otherwise arranged. We accept major credit/debit cards, bank transfers, or other methods as agreed upon.
5.3. Refunds:
- Inspection Services: Inspection fees are non-refundable once the inspection process has commenced or been completed.
- Training Services:
- Refunds for training courses are subject to specific terms outlined in your individual enrollment agreement.
- Generally, a non-refundable deposit may be required to secure your spot.
- Refunds for course fees are typically prorated based on course progress (e.g., prior to receiving digital materials, prior to confined water training, etc.). No refunds will be issued once a course has commenced past a certain point or for failure to meet performance requirements.
- Rescheduling fees may apply if changes are made within a specified short notice period.
- General: No refunds will be given for services that have been fully rendered.
6. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images, software, and the compilation thereof, and any Inspection Records, are the property of Skelly Scuba, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Materials on our Website without our prior written consent.
7. Disclaimer of Warranties
THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
